1. Use of the website

This Site is available to all users (hereinafter referred to as “User” or “You”), subject to these General Terms and Conditions.
When you make a purchase on the Site or otherwise use the Site, you signify your acceptance of these Terms and Conditions.
Management of this booking platform and related beach entrance verification services is carried out by Oikos Servizi Srl.
You represent that he/she is an adult (at least 18 years of age) and has the legal capacity to be bound by this Agreement and to use the Site in accordance with these terms and conditions, which he/she fully understands and accepts.
This site is solely and exclusively for the User’s personal use. It may not be modified, reproduced, duplicated, copied, distributed, sold, resold, or exploited for commercial or noncommercial purposes, except for the ability to print copies of one’s travel itinerary for personal use.
The User agrees not to use this website for illegal or prohibited purposes. Specifically, the User agrees that he/she will use the website exclusively for him/her and that the services purchased through this website will be for his/her own personal use or consumption, or the use and consumption of the persons on whose behalf he/she is legally authorized to act.
The User may not resell services purchased through this website to third parties.

2. Definitions

Unless otherwise indicated the following terms and expressions will have the following meanings:
– “User,” “you,” and “your” refer to you as the purchaser of beach access made from this Site;
– “Booking Confirmation” has the meaning of transmitting the confirmation email;
– “Platform” refers to this site (also, the “Site”), the App, Widgets, tools, platforms or other devices intended to manage reservations for access to La Pelosa Beach.
– “Reservation” means the reservation of beach beach access for a specific date, requested via Site, App or Widget;
– “Beach regulations” the regulations approved by the Municipality of Stintino in force on the date of reservation and/or use of the reservation;

3. Reservations and Confirmation

The Reservation submission process allows you to properly check and correct any errors before confirming your Reservation to us, so it will be your sole responsibility to ensure that the Reservation details are correct before submission.
Please note that the Reservation Agreement is deemed to be concluded when we send you the confirmation of the Reservation (usually with an e-mail: the “Reservation Confirmation”). Confirmation of Reservation shall mean your receipt from us which will give you the right to access La Pelosa beach.
Confirmation of the Reservation is considered to be made with the sending of the confirmation email itself. Therefore, we are not liable for non-receipt of the same if it is blocked or placed in the receiver’s spam.
The applicant will not be entitled to reimbursement and/or reservation postponement in case of bad weather on the booked day and in any other case.
We reserve the right to deny access to our Site and/or App as well as the right to cancel Reservations if you fail our fraud prevention checks or if we have a reasonable suspicion of fraud or false reservations by you or anyone using your account.
Each reservation may not be requested for more than 4 people, and a single user may not make more than one reservation per day.
It is not necessary to include children under the age of 12 in the reservation (or pay the relevant fee).
The daily price is 3.50 (three point fifty) euros per person.
Payment for the reservation can only be made online from this Site or the linked App using payment cards, including rechargeable cards. Payments will be processed through the Stripe platform and the payment card information used will not be stored by us.

4. Beach access

To gain access to the beach, the user will need to show the control staff the QRCode, which can be downloaded by clicking on the link in the Booking Confirmation or otherwise the booking order number.
All persons included in the reservation must access the beach at the same time so there is no possibility of separate access or multiple uses of the QRCode or order number.

5. Exception to the right of withdrawal – cancellation Reservations
Once the Reservation Confirmation is received, it will not be possible to cancel the Reservation and receive a refund of the price paid for the Reservation, except as stated in the preceding paragraph.

6. Privacy

7. Industrial and intellectual property rights

All content on the Site is the property of the company Oikos or its Software and/or Content Providers, and is protected by national and international intellectual and industrial property laws.

8. Limitations of liability

Oikos Servizi Srl offers this Web site “as is” and makes every reasonable effort to update, maintain, and operate it, but makes no warranty regarding any technical problems or that the system or portal will function at all times.

9. Links to other websites

The Site may contain links to other websites that are not operated by Oikos Servizi Srl. The latter exercises no control over these sites and is not responsible for their content.

10. Changes to the General Terms and Conditions

Oikos Servizi Srl reserves the right to modify and/or update these General Terms and Conditions from time to time without notice to you. The current version of the Terms and Conditions will be displayed within the website from the date the changes take effect. Use of the Site after any changes to the Terms and Conditions constitutes acceptance of those changes.

11. Applicable law and jurisdiction

These General Terms and Conditions, are governed by the national and international laws in force in Italy. In particular, the purchaser agrees and undertakes to comply with the regulations for access to the beaches approved by the Municipality of Stintino, which shall be considered an integral part of these conditions for all purposes.
